Please read these Terms and Conditions of Use (“TOU”) carefully. The party purchasing this theme must agree to these TOU before you are permitted to use any digital or downloadable, theme, template, resource, class, program, workshop, or training, operated by Atcore Digital LLC DBA http://www.growthnatives.com .Growth Natives (for any purpose), whether on a website hosted by Growth Natives or a third-party website such as hubspot.com, any online marketplace, or an online course platform (collectively “the Theme”).

If you do not agree with these TOU, you may not use the Theme.

  1. License Agreement:

    • By purchasing and downloading our theme, you agree to the terms of this license agreement.
    • This license grants you the right to use the theme on a single website domain for personal or commercial purposes.

  2. Restrictions:

    • You may not redistribute, resell, or sublicense the theme in any form, modified or unmodified, without prior written consent from Growth Natives.
    • You may not use the theme in any way that violates any laws or regulations.

  3. Intellectual Property:

    • All intellectual property rights related to the theme, including but not limited to trademarks, copyrights, and trade secrets, are owned by Growth Natives.
    • You may not claim ownership of any part of the theme or create derivative works based on the theme without Growth Natives express permission.

  4. Support and Updates:

    • We provide limited support for the theme via email (ma_support@growthnatives.com)
    • Updates to the theme may be provided at Growth Natives discretion and are included for a limited time after purchase.

  5. Refund Policy:

    • We offer a 30-day money-back guarantee if you are not satisfied with the theme for any reason. Please contact us within 30 days of purchase to request a refund.
    • You can request a refund in the HubSpot marketplace. Request a refund by clicking on the “purchased” tab. Click the dropdown on the theme or single template you purchased, and select "Request a refund". We follow HubSpot’s Marketplace Refund Guidelines which HubSpot may update, so contact us at ma_support@growthnatives.com if you have any trouble with your refund request.

  6. Disclaimer of Warranties:

    • We make no warranties regarding the performance, reliability, or suitability of the theme for any particular purpose.
    • The theme is provided "as is" without any warranties of any kind, express or implied.

  7. Limitation of Liability:

    • We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the theme.
    • In no event shall Growth Natives total liability exceed the amount paid by you for the theme.

  8. Indemnification:

    • You agree to indemnify and hold harmless Growth Natives and its affiliates, officers, directors, employees, and agents from any claims, damages, or losses arising out of your use of the theme.

  9. Governing Law:

    • This agreement shall be governed by and construed in accordance with the laws of your jurisdiction.
    • Any dispute arising under this agreement shall be resolved exclusively by the courts of your jurisdiction.

  10. Termination:

    • We reserve the right to terminate this license agreement at any time if you violate any of its terms.
    • Upon termination, you must cease all use of the theme and destroy all copies of the theme that you have in your possession.

  11. Miscellaneous:

    • This agreement constitutes the entire agreement between you and Growth Natives regarding the use of the theme and supersedes all prior agreements and understandings.
    • If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
